What is the Windrush Compensation Scheme?

The term, Windrush Generation, refers to individuals who arrived in the UK from Commonwealth countries, between 1948 and 1973. During this period, those arriving from Commonwealth countries had the right to live nd work in the UK permanently. However, the UK Government often did not issue formal paperwork to prove this right.
For many years, this lack of documentation did not pose a significant issue. However, with stricter immigration enforcement, those unable to prove their right to live in the UK faced severe repercussions. This resulted in countless members of the Windrush Generation being unfairly deprived of their rights and access to essential services, such as employment, driving licenses, housing, and healthcare.

The Windrush Compensation Scheme was established by the UK government to compensate individuals who suffered losses due to not being able to prove their lawful right to live in the UK.
This includes those who were wrongfully detained, denied legal rights, threatened with deportation, or refused re-entry into the UK.

How the Windrush Compensation Scheme works

You may be eligible for compensation if you:

  • Came to the UK from a Commonwealth country before 1st January 1973.

  • Are a Commonwealth citizen who settled in the UK before 1988.

  • Are a child or grandchild of a Commonwealth citizen who settled in the UK before 1988.

  • Are the close family member of someone who has a right of abode or settled status in the UK and you experienced significant difficulties due to their inability to demonstrate their lawful status.

  • Were wrongfully detained, deported, or experienced significant hardship because of the Windrush scandal.

How to apply for Compensation;

  1. Prepare your application
    Gather all relevant documents that prove your identity and your circumstances. This may include passports, birth certificates, utility bills, employment records, and any correspondence with government departments.

  2. Fill out the application form
    The application form can be found on the UK Government website. You can complete it online or download a copy to fill out by hand.

  3. Submit your application
    Submit your completed application form along with all supporting documents. You can do this online, by post, or via email.

  4. Seek assistance
    If you need help with your application, NuDawn CIC is here to support you. We offer workshops, one-on-one consultations, and introductions to those able to provide legal assistance to guide you through the process.
